Can You File a VCF Claim If You Left New York? Out-of-State 9/11 Claimants

An out-of-state VCF claim is every bit as valid as one filed from Manhattan or New York State, but many of the people don’t know that. Tens of thousands of 9/11 first responders, recovery workers, and survivors have moved out of New York City in the years and decades since the attacks. Many retired on disability, relocated for family reasons, or simply chose to start over somewhere else. A significant number of them believe (incorrectly) that leaving New York means they are no longer eligible for the September 11th Victim Compensation Fund. This is one of the most consequential misconceptions about VCF eligibility. It has caused real harm.  People who are fully entitled to compensation have not filed because they assumed geography disqualified them.

It does not. If you were present at an eligible 9/11 site during the qualifying period and have developed a certified condition, your current state of residence is irrelevant to your VCF eligibility. The VCF Is a Federal Program. Not a New York State Program.

The September 11th Victim Compensation Fund was established by federal law. A Special Master appointed by the U.S. Attorney General administers it at the federal level. There is no residency requirement. The VCF compensates for exposure that occurred in New York, Pennsylvania, and Virginia. It does not compensate for exposure that is currently occurring. Where you live now has nothing to do with where you were on September 11, 2001, or during the months of recovery that followed.

This is true for both responders and survivors. An NYPD officer who moved to Florida after disability retirement is just as eligible as one who stayed in Brooklyn. A lower Manhattan office worker who moved to Texas in 2005 is just as eligible as one who still lives on the Lower East Side.

Common Out-of-State Scenarios

Out-of-state responders make up one of the largest groups of out-of-state claimants. Construction workers, sanitation workers, and other tradespeople who came to New York specifically to work on the WTC recovery often returned to their home states after the cleanup ended. They worked the site during the qualifying period. They may have developed conditions that trace back to that exposure. They qualify fully for VCF compensation. But no one has ever told them.

Out-of-state survivors form a more varied group. Some worked or studied in lower Manhattan and left after the attacks or after a job or graduation. Others retired and moved away from New York. The common thread: they all spent time in the exposure zone during the qualifying period. Some have since developed certified conditions.

Responders from other jurisdictions, for example police officers and emergency personnel from surrounding states who came to assist with the 9/11 response also qualify. If your department deployed you to the WTC site or another eligible location as part of mutual aid or emergency assistance, you may qualify regardless of where that department sits.

The WTC Health Program for Out-of-State Claimants

The WTC Health Program operates through a national network of providers to accommodate out-of-state claimants. If you live outside the New York metropolitan area, you may be able to receive evaluation and care through a program-affiliated provider in your region, or through telehealth services for certain consultations. Enrollment in the program is still required before your conditions can be certified. But the enrollment and evaluation process does not require you to travel back to New York for every appointment.

Proving Presence From a Distance

The most practical challenge for out-of-state claimants is often the documentation of presence at a qualifying 9/11 site. This is particularly true if it has been 20+ years and records have been lost, employers have closed, or the claimant simply did not save relevant documents at the time.
